In 2013, Lambda Legal submitted a petition on behalf of a gay married couple in Nevada who were told the HIV-positive status of one of them prevented the men from being foster parents. The petition was joined by Aid for AIDS Nevada and the Children’s Advocacy Alliance.
The men were denied as a result of regulations requiring foster parents to be free from a list of communicable diseases, which included HIV. In a cooperative process, the Division of Child and Family Services of the Nevada Department of Health and Human Services revised its regulations.
According to a statement by Lambda Legal, any reference to communicable diseases in reference to foster care has now been removed. Instead, each foster parent “must be in sufficiently good physical and mental health, and be physically and emotionally capable, to provide the necessary care to children.”
